1. General information on data processing
1.1 Purpose of the data protection statement

When you contact Futuro Immobilien AG (hereinafter referred to as "we" or "us"), personal data that falls under the Data Protection Act (DSG) and the Data Protection Ordinance (DSV) is usually processed. This data typically includes name, mail address, telephone number and personal information related to contractual relationships with us. In addition, technical data that can be assigned to a person is considered personal data (esp. cookies, see below).
This privacy policy explains the nature, scope and purpose of the processing of personal data by us.
1.2 Legal basis
The legal basis of our data processing is namely Art. 5-9 DSG ("Terms and Principles"). The measures we take are based on the "Industry Recommendation on the Revised Data Protection Act" issued by SVIT Switzerland.
In order to protect the managed data against manipulation, loss, destruction or access by unauthorized persons in accordance with the current state of the art, we use modern technical security measures and improve them continuously.
1.3 Processed personal data
The personal data processed by us includes personal data worthy of protection within the meaning of the DSG. Particularly sensitive personal data will only be processed in individual cases and after a corresponding declaration of consent (e.g. extracts from the debt collection register, creditworthiness information). Personal data is treated as strictly confidential and is neither sold to third parties nor passed on without your consent.
1.4 Your rights
In accordance with Art. 25 DSG, every person has the right to request information from us free of charge about whether personal data about him or her is being processed. From the second information within 12 months, we may charge a fee to cover the costs (according to Art. 19 para. 2 DSV maximum 300 CHF).
Subject to Art. 28 para. 1 DSG, every person has the right to demand that we hand over the personal data he or she has disclosed to us in a standard electronic format.

2. Processing procedure
2.1 Rental process
In the leasing process, personal data is collected from owners, prospective tenants and tenants to the extent necessary for the process or for lease agreements. By disclosing personal data, the persons concerned declare their consent to data processing.
We inform data subjects in the leasing process that we obtain personal data from third parties (namely business information). We inform the data subjects in an appropriate manner about the source of the externally obtained personal data. Personal data of prospective tenants is deleted after completion of the leasing process, unless the process results in a lease or the data subject gives consent to use the personal data for a subsequent leasing process.
Personal data collected from current rental orders and rental agreements prior to the entry into force of the DSG will be processed without further notice. Personal data of prospective tenants collected prior to the entry into force of the revised DSG will be deleted unless consent to data processing has been obtained.
Rental agreements and the related personal data are kept for 10 years beyond the last contractual performance (usually settlement of ancillary costs or reimbursement of the rent deposit) in accordance with the principles of the general statute of limitations (Art. 127 OR).
2.2 Sales process
In the sales process, personal data is collected from sellers, prospective buyers and buyers to the extent necessary for the process. By disclosing personal data, the persons concerned declare their consent to data processing.
Personal data of sellers and buyers as well as documents relating to the process will be stored for a period of 5 years (complaint and limitation period according to SIA).
All personal data of prospective buyers will be deleted after completion of the sales process, unless the person concerned consents to the use of the personal data for a subsequent sales process. The right to anonymous storage is reserved.
2.3 Consulting process
Personal data from consulting mandates will be retained for 2 years beyond the conclusion of the consulting mandate. The right to anonymous storage is reserved.
2.4 Cooperation with third parties
We cooperate with a wide range of external partners to provide our services. The condition for the cooperation is the DSG- or DSGVO-compliant data processing of the order processors. In individual cases, the relevant data protection provisions may differ from ours.
The disclosure of personal data to cooperation partners takes place exclusively for the purpose of fulfilling our services and only to the extent necessary for this purpose. We inform the persons concerned about the disclosure.
2.5 Disclosure of personal data abroad
Data processing servers may be located abroad and order processors may be based abroad. However, we work exclusively with order processors who undertake to process data in compliance with the DSG and DSGVO.
2.6 Customer Relationship Management
Personal data in our customer relationship management system (CRM system) only includes the information required for the contact or business relationship. Personal data is stored for 2 years beyond the last customer contact and then deleted. We reserve the right to store the data anonymously.
2.7 E-mail
We store our e-mail traffic for a period of 1 year from the last e-mail conversation in a conversation history, if an ongoing business relationship or the like does not require the longer storage.
2.8 Contact form
Personal data from digital contact forms are deleted from our web servers within 1 month. Further processing takes place via e-mail (see above), telephone or personal contact. By sending your message, you consent to the processing of the transmitted data. The processing is based on your consent. Without additional consent from you, this data will not be disclosed to third parties.
2.9 Events
Personal data from registrations for and participation in public events that we organize are deleted after 1 year.
2.10. Mailings via postal mail and social media
For addressed advertising mailings via letter post, we use addresses from AZ Direct, which we use once in each case in accordance with the terms of the contract. For paid postings on social media (LinkedIn, Instagram, ...), we use the contact data of the respective providers.
2.11. Creditworthiness information
Insofar as necessary for our services, we incorporate creditworthiness information from the provider Creditreform into our decisions (e.g. for rentals). To obtain a credit report, data subjects should contact us directly at: www.creditreform.ch/basel.
2.12. Automated individual decisions
We use automated individual decisions for the rental process in our company, which fall under the exceptions according to the DSG. Specifically, this means that all automated individual decisions are reviewed by a natural person and changed if necessary.
2.13. Data backups
In the interest of data security, we regularly create data backups of our business data, which are stored on data carriers and cloud services in Switzerland. The frequency of data backups is based on relevant recommendations.
2.14. Data protection measures
Data security is an important concern for us. Our measures to protect against unauthorized access are based on the recommendations of the National Cyber Security Center (NCSC) of the Swiss Confederation.
2.15. Website/s
In addition to the domains futuro-immobilien.ch, the website also includes project-related websites and services provided by service partners. Visitors to the website are not required to provide personal data unless we indicate otherwise in individual cases. Our content can be used without registration. However, we use industry-standard technologies to measure and improve the performance of our website and collect data for this purpose.
2.16. Use of cookies
Cookies are data that are stored by our websites via the browser on the user's terminal device. The cookies we use serve on the one hand to increase and improve the user-friendliness of our websites. On the other hand, cookies help us to collect statistical data on website usage and to use the data thus obtained for analysis and advertising purposes.
Some cookies are automatically deleted from your terminal device as soon as the browser is closed (so-called session cookie). Other cookies are stored for a certain period of time, which in each case does not exceed 2 years (persistent cookies). In addition, we may also use so-called third-party cookies, which are managed by third parties to provide certain services.
You can influence the use of cookies. Most browsers have an option to restrict or completely prevent the storage of cookies. However, we would like to point out that the use and especially the comfort of use will be limited without cookies.
2.17. Server log files
We automatically collect a number of technical data each time this website is accessed, which are personal data.
These are:
- IP address of the user
- Name of the accessed website or file
- Date and time of access
- Message about successful retrieval
- Browser type and version
- Operating system of the user
- Referrer URL (the previously visited page)
Server log files are not merged with other personal data. We collect server log files for the purpose of administering and improving the website and to be able to detect and prevent unauthorized access. Server log files are collected and analyzed by our contract processors (IT service providers).
The server log files with the above-mentioned data are deleted after 6 months at the latest, unless there is a legitimate interest or a service-oriented concern. We reserve the right to store the server log files longer if facts exist that suggest the assumption of an unauthorized access.

The copyright and all other rights to the content, images, photos or other files on the website belong exclusively to Futuro Immobilien AG, its licensors or the specifically named rights holders. The written consent of the rights holders must be obtained in advance for the reproduction of any elements.
4. Liability
We do not assume any warranty with regard to the correctness, accuracy, timeliness, reliability and completeness of the information. Liability claims against us for damages of a material or immaterial nature arising from access to or use or non-use of the published information, through misuse of the connection or technical faults are excluded. All offers are non-binding. We expressly reserve the right to change, supplement or delete parts of the website or the entire offer without prior notice or to discontinue publication temporarily or permanently. References and links to third party websites are outside our responsibility. Any responsibility for such websites is declined. The access and use of such websites is at the user's own risk.
